SV "Falls of Clyde"

BBC Scotland news is this morning reporting that the "Falls of Clyde", up until recently a museum ship moored at Honolulu in Hawaii, is to be returned to the Clyde early next year. Belatedly, many thanks for this info Alasadair –

Been doing some research into this – according to http://www.friendsoffallsofclyde.org/ships-log as at 1st December 2018, appears the scheduled departure is 3rd February 2019 with an ETA “in Scotland” of 28th March.

The transportation is being done by Sevenstar Yacht Transport – would appear however that “financial support is needed to help underwrite the move”.

Think we need to "wait and see"......

According to "The Friends of Falls of Clyde" website, the move back to Scotland, departing 3rd February, has been cancelled.

Save the Falls of Clyde International – the group responsible for the move, have said that they are “not ready”.

However, apparently the clock is ticking – the State DOT-Harbors Division has given a deadline of 6th February “to remove the ship”.

Update now lodged -

Looks like the proprietors of “The Friends of Falls of Clyde” are having problems.
Their latest update confirms there have been issues – full details at http://www.friendsoffallsofclyde.org/ships-log

Basically, the ship’s integrity has been compromised, weaknesses have revealed water inlets which have been what appears to be temporarily repaired.

However, the Harbour Authorities are taking a stance, in that the ship must be moved, for the safety of the harbour.

Been having a look at the Notice of Public Auction, issued by the Harbors Division of the Department of Transportation of the State of Hawaii:–

Potential bidders have/had until today to inspect the vessel and its contents, “at their own risk”.

Each bid must be accompanied by a Performance Bond of $1,500,00.00 guaranteeing the removal of the vessel within 60 days from the Bill of Sale.

The entire vessel must be removed from the Honolulu Harbor within 60 days of the Bill of Sale.

10% of the bid payable at the fall of the hammer, balance payable within 30 days of Bill of Sale.

Bids must be received no later than 1100hrs 28th February 219, public announcement of the winning bidder will be made at 1300hrs 28th February 2019.

Looking forward to see what happens……

Update on the “Friends of Falls of Clyde” indicates that the ship has not been sold.

Only three parties made themselves known at the “open house” day on 15th February - on the day of the auction, no qualified bidders had appeared; the fact that a $1.5million bond was required is thought to have been a major stumbling block.

The Harbors Division apparently now have three options:-
a) Negotiate a sale
b) Transfer the ship to another government organisation
c) Remove and destroy the ship.

‘Friends of Falls of Clyde’ is looking into the legal options to try and forestall the last option.

Update on the position here –

Information posted on 18th March indicates that Friends of Falls of Clyde (FOFOC) were instructed to remove all property from the ship, and remove their lock from the Pier Gate.

Their response was to write to the Harbors Division, highlighting five issues: -

a) Challenging the auction, on the grounds that the requirement to post a bond of $1.5 million undermined the process.
b) Asserting violation of owners’ rights to ship access.
c) Asking for confirmation of awareness of Federal and State requirements re negative action toward a national historic landmark.
d) Information relating to costs of removing the ship from the harbour, as this would be “public expenditure”.
e) FOFOC are seeking legal advice on protecting ownership rights.

Would appear this is heading towards legal action and, regrettably, unavoidable costs – no doubt something FOFOC will not be relishing.

Extract from the bi-montlhy update on FFOC website:-

The FFOC are still waiting for a response to their questions to the Harbors Division; on the down side, they cannot access the pier and ship independently and the Harbors Division have appointed a contractor to ostensibly maintain the ship.

FFOC have been advised that the Harbors Division has not yet approached any regulatory agencies, nor have any plans been set out by them.

FFOC are consulting with the National Trust for Historic Preservation, as to the regulatory and legal issues.

They report no progress as to arranging heavy lift/transport with a view to removing the Falls of Clyde; if this could be achieved, it would help to appease the Harbors Division.

No material developments last month -

There is nothing material to report and we feel like we are in a state of limbo. The Harbors Division has still not responded to the questions we have asked nor has Save Falls of Clyde International been able to finalize the contract with a heavy lift company to move the ship. We continue to hope for the best, but time is running out for the Scotland Plan to be successful.
